Terms of Use

These Terms of Use ("Terms") govern your access to and use of the mobile applications published by NexaByte Apps ("we," "us," or "our") (each, an "App"). By downloading, installing, or using any App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use.

2. Subscriptions and In-App Purchases

  • Some features require a paid subscription or one-time purchase, billed through the Apple App Store or Google Play.
  • Subscriptions automatically renew for the same period unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription anytime in your Google Play (Android) or App Store (iOS) account settings.
  • Token packs and other one-time purchases are consumed upon use and are non-refundable, except where required by applicable law or the policies of the App Store/Google Play.
  • Prices are shown in your local currency at checkout and may vary by region.

3. User Content

Some Apps allow you to upload photos or other content ("User Content") to generate AI-based output. You retain ownership of your User Content. By submitting User Content, you grant us a limited license to process it solely for the purpose of providing the requested AI generation feature. You represent that you have the necessary rights to any User Content you submit, and that it does not violate any third party's rights or applicable law.

You agree not to upload or generate content that is illegal, infringing, obscene, defamatory, or that depicts real individuals without their consent for harmful or deceptive purposes.

4. AI-Generated Content

Output generated by the App is produced using third-party artificial intelligence services. AI-generated results may sometimes be inaccurate, unexpected, or unsuitable for your intended use. We do not guarantee the accuracy, quality, or fitness of AI-generated content for any particular purpose, and you are responsible for reviewing and deciding whether to use it.

5. Intellectual Property

The App, including its design, code, graphics, and branding (excluding User Content and AI-generated output), is owned by NexaByte Apps or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the App except as permitted by applicable law.

6. Advertising

Free or ad-supported plans may display advertising served through Google AdMob. Ad content is controlled by third-party advertisers, and we are not responsible for the content of ads shown.

7. Prohibited Conduct

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to the App's systems; (c) interfere with or disrupt the App's operation; (d) use automated means (bots, scripts) to access the App; or (e) circumvent any purchase, token, or usage-limit mechanism.

8. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and uninstall it at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated results will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, NexaByte Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of or inability to use the App, even if advised of the possibility of such damages. Our total liability for any claim relating to the App shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

11. Changes to the App and Terms

We may modify, update, or discontinue the App or any of its features at any time. We may also update these Terms from time to time; changes will be posted on this page with a revised "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles, and any disputes shall be resolved in accordance with the laws applicable to the platform (Apple App Store or Google Play) through which you obtained the App, to the extent required by that platform's policies.
